Excuses, Excuses, Excuses
So here we are, it's Friday, another week has gone by for us all and no progress has been made toward our projects getting completed. I would like to say that I am surprised but to be honest this is now a pure reality...MY PROJECT WILL NOT GET COMPLETED BY D.E.FREEMAN. Mr Freeman came to my house last night and promised me to my face that the Granite House would get their money so I could get my granite and Matrix Cabinets would be paid so I could have what I ordered. All of this was to be done by noon today. At 10am I text him with "I have not heard from you". He instantly replied back, "you will". Well, when noon came around Mr Freeman never returned my calls, texts or emails. He hid. He hid from the fact that he once again did not live up to his word or deadline. I was not surprised and honestly, I never once believed that he would follow through. I think I would have had a heart attack and wondered where/who he had stolen the money from if he had been a man of his word.
We all get tired of waiting for things to be made right. We have been set into financial crisis, emotional turmoil, relationship chaos and family tornadoes. Who is this man to do this to so many people??
This man is a man that decided to enroll himself in a mental health facility today because he has told people he has "had enough". Guess what, we have all had enough! Instead of running from the truth things need to be made right. Self destruction is by no means the answer and I do not condone it for one moment! This is the easy way out! There needs to be justice for all of us out here who have fallen victims to this con man!
I am feel very passionately about this because what has been done to over 30, yes OVER 30 people that I personally have been in contact with is not right! I am sure there are more victims out there because the web keeps getting more and more complex.
I am still working night and day to get in contact with as many people as I can. Even if I have spoken with you please please please email me with the list I posted yesterday. This way I can print out the information and place it into the file that I have created for each and everyone that I have spoken to.

I want as much evidence as we can gather ahead of time so that our case is strong and does not get put into a file cabinet in any city!

A cabinet maker authorities say bilked a large number of people out of money entered guilty pleas in Criminal Court on Wednesday morning.
David Freeman, 50, appeared before Judge Rebecca Stern.
He was given sentences totaling 16 years, but he will be released after serving 180 days.
Prosecutor Boyd Patterson said Freeman will be required to pay back those he owes. He said if he does not pay, then he will have to serve the entire 16 years.
He pleaded guilty to three counts of felonious misapplication of contract payments and three counts of theft over $1,000.
Prosecutor Patterson said a number of people in Hamilton County as well as nearby counties and in other states were put in financial jeopardy due to Freeman promising cabinets, then keeping the money without delivering the cabinets.
He said Freeman has entered pleas in Rhea and Sequatchie counties and will be taken to Georgia next.
Family members praised the work of Channel 9 consumer reporter Calvin Sneed for helping to identify victims of the fraud.

A former cabinet salesman is still cooling his heels in the Hamilton County Jail..
Yesterday, David Freeman pleaded guilty to taking money for cabinets, and never delivering those cabinets to customers..
Turns out, Freeman had a date in court TODAY in Catoosa County, Georgia for allegedly doing the same thing there, too.
He's charged with theft by deception and theft by conversion.
"A bench warrant was issued for his arrest by the judge," said Len Gregor, Assistant District Attorney for the Lookout Mountain Judicial District, "if Mr. Freeman is in custody somewhere else, that will act as a hold so we can get our hands on Mr. Freeman in the future."
The Catoosa County Criminal Court also has a warrant out for Clay Moerland, who's charged with theft of a backhoe from a Ringgold business.. he was first brought to our attention, when a homeowner CALLED CALVIN, saying Moerland, who was a building contractor, installed the siding on her home upside down and backwards..
Moerland is in the Rhea County Jail charged with possession of meth and drug paraphernalia..

A big realization...
The same list as yesterday still needs to be completed in my kitchen...NOTHING has changed. NOT THAT I AM SURPRISED... David promised that the granite would be paid for by Monday (one of the many deadlines), in 45 minutes it will be Thursday and it has STILL not been paid for. I am forced to believe that no action is being taken since this is 26 days after I was promised that it would be paid. I can not continue to wait for one deadline to pass just for another to be created. The longer I wait, the more permanent this granite becomes in my house.

Should have followed all of this advice...AVOIDING CONTRACTOR SCAMS
HOW TO AVOID GETTING SCAMMED: GET IT RIGHT!!!
It's a bold title, and it's meant to get your attention. There are a lot of fly by night contractors around. I'm sure you've heard the stories. But at the same time, there are also some very good contractors in business with an ongoing commitment to quality construction and good customer service. You just have to know how to determine the difference.
Virtually all homeowners approach the contractor selection process with anxiety and even dread. Some feel prospective contractors won't be completely honest about cost and fear being tempted by appealing promises or low-ball estimates. The abundance and variety of construction horror stories leads others to believe there are only unqualified contractors out there ready to take advantage of the unsuspecting. Then others despair because they've heard of a homeowner who did shop carefully, hired a "very reputable" contractor and still had a bad experience. Its little wonder most home owners feel unsure where to begin and what questions to ask.
Feeling confident you'll choose well is very difficult. If we add the haunting thought that thousands of dollars are at stake to this mix of doubt and dread, the burden's enough to keep many from ever starting.
I encourage you to step beyond this bind. During the selection process your fears don't have to rule you because it's possible to find not just a good, but an excellent contractor. By following my plan, you'll learn how to spot good contractors, build a list of qualified candidates, and test them so you choose the contractor best suited for your job. You'll find the selection process is not only manageable, but also informative and rewarding. As a bonus, it can aid in the development and refinement of your home's design.
Below is a summary of the simple steps you'll need to take to find the right contractor. As you look over this list you may think "this looks too easy and obvious to be of any use." On one level you are correct. When you think about it, the plan is obvious and very straightforward. But as you read on, you'll see that I equip you with two powerful tools that make you master of the process.
PART ONE: THE INTRODUCTORY CALL, YOUR FIRST CONTACT WITH PROSPECTIVE CONTRACTORS
Most people don't like interviewing contractors because they don't have confidence in their ability to discern if a contractor is honest. If you've done your homework with thoroughness and patience, you've spared yourself that anxiety because you already know your candidates are qualified, honest and reliable.
When you begin contractor interviews, your task will be to locate a contractor you can work with, one whose interest in your project impresses you, one who listens carefully to what you say. The goal of this quest is to find compatibility with a contractor whom you'll be able to work with successfully for the time necessary to complete your project.
Once you're ready to begin the interviewing process, call the contractors in the order you've rated them. Be prepared to describe your project and state when you'd like to begin construction.
When you call the contractors on your list, have three to five preliminary questions ready to ask each. Here are some suggestions:
There is no set script for these calls. In fact, in the course of some conversations a contractor may offer everything contained above and more. Be aware of how easily the conversation progresses. When you hang up, make a few notes on the conversations. What were your impressions of the contractor? Did he or she listen well? Did he or she answer your questions thoroughly?
PART TWO: YOUR FIRST MEETING WITH PRESELECTED CONTRACTORS
In this new relationship, common courtesy is a must and good contractors understand this. If a contractor fails to show up for your first meeting and does not call to reschedule, cross him off your list.
In regards to this first appointment, let me state definitively that all principal parties should be present at this initial and all subsequent meeting. This includes the contractor and BOTH spouses, if applicable. This is absolutely essential for all parties to participate fully in the interview process and for everyone to operate with equal information.
Listed here are questions you should ask during your first meeting.
CONTRACTOR QUESTIONS
BUSINESS IDENTITY:
-How long has the firm been in business?
-What is their permanent business address?
-Is the prospect licensed to work in your area?
-What year was the business initially licensed?
BUSINESS PRACTICES
-How does the company ensure warranty service complaints are effectively handled?
-In case of any accident, is the company insured against workman's compensation claims, property damage or personal liability?
-How does the company maintain good customer relationships throughout the construction and warranty period? (applicable in longer projects)
-What will the payment or draw schedule look like (applicable in longer projects)
BUILDING PRACTICES (applicable in longer projects)
-Who will be assigned as the project or site supervisor?
-Who will be your contact if that person is not available?
-Will there be a supervisor on the site full time?
-Will they be providing a written construction schedule?
-What's the company's routine regarding regular meetings with the homeowners during construction?
-Who will attend those meetings? Will the builder personally attend every meeting?
-Can I expect to see workers at the site every day?
-Does the builder plan to stay personally involved in the project at all points?
-May I have the names and numbers of five homeowners you've completed projects for?
-May I visit a site where work is in progress?
Note: A visit to a site in progress can reveal much about a company's ability to manage a large project. Notice how organized it looks. Is it messy and chaotic or does it seem well-organized with workers moving like they know what they are doing?
This list is not intended to be exhaustive. In fact, it should help you generate other, more personal questions.
I cannot encourage you strongly enough to ask any questions you may have. Nothing is off limits concerning your project or the company you're interviewing. Asking good, detailed questions is the heart of your due diligence. If you don't question thoroughly, you're giving up your responsibility in this process and possibly compromising the quality of your project.
HOW TO NARROW THE FIELD: TRUST BUT VERIFY
You should suggest second meetings with your preferred candidates to discuss your project in greater detail. Second meetings provide an important chance to ask those questions you overlooked in your first meeting, plus the key questions that will enable you to identify the builder you'll move forward with. Trust the representations your favorites make, but verify them. Your due diligence may protect you from confusing an itinerant contractor with an established professional.
Below I outline steps to objectively verify your candidates' business representations. Among them are several items you should address during your second meetings if you didn't during your first.
Number one, they should be licensed, as required. Ask for a copy of their business license.
Second, obtain proof of insurance. The contractor should supply you with a Certificate of Insurance indicating it has a sufficient general liability and workmen's compensation insurance. Additionally, the contractor should have coverage against theft of any materials delivered to the job site but not yet installed.
Number three; confirm the contractor's business address. He may have an office, but it's also common for contractors to work out of their homes. Ask for a visit just to confirm your candidate isn't working out of the back of a truck or a post office box. What you're trying to determine here is your candidate's permanence.
Number four; for bigger projects, you can call the Better Business Bureau and your local consumer affairs office to check the company for consumer complaints. Better Business Bureaus (BBBs) are non-profit organizations supported primarily by local businesses, which encourage honest advertising and selling practices and keep records of consumer complaints. Check your candidates' records, but remember that just as there are unreliable contractors, there are also unreasonable homeowners. Even a good contractor can receive a complaint. If a favorite has a complaint, ask for information about its resolution. If he addressed it quickly and to the client's satisfaction, that's a sign of professionalism.

Former Cabinet Salesman Pleads Guilty in Hamilton County

David Freeman has now faced justice in Hamilton County for his crimes..
After we first started doing stories on Freeman a year ago, the floodgates opened up and homeowners from all over the area called to tell me they'd lost money to him..
In Rhea and Sequatchie Counties, Freeman spent time in jail after our stories, and was ordered to pay folks back the money he'd stolen from THEM..
His charges in HAMILTON county, have now been settled, too..
The scene in July of last year, outside a Hamilton County courtroom was one of nervous apprehension..
Assistant District Attorney Bill Boyer, announced to a crowd of angry homeowners, that he's holding three felony charges on former cabinet salesman David Freeman..
The crowd of homeowners had all paid thousands of dollars to David Freeman and his company Kitchen Resources to have cabinets built and installed..
None of the cabinets were ever made..
"He's taken good people in this community for a ride," homeowner Burt Elliott told the group..
Mr. Elliott was one of Freeman's victims.. he'd paid Freeman 26-thousand dollars for cabinets and shelving that was never done..
Vivian Putnam was another victim.. her loss was four-thousand dollars..
"I got cheated out of two kitchens," she says, "because he did nothing for me."
Freeman was eventually charged in Hamilton County with three separate counts of felonious misappropriation of contract funds..
"Mr. Freeman?" asked Hamilton County Criminal Court Judge Rebecca Stern, "in count one of misappropriation of contract payments, how do you plead?"
"Guilty," Freeman replied..
He pleaded guilty to all three counts..
Both Ms. Putnam and Mr. Elliott were in court, as Freeman also admitted to three counts of theft of property over a thousand dollars..
"How do you plead?" again asked Judge Stern..
Again, "guilty" was the reply from Freeman..
"Good trusting people can be taken easily," says Mr. Elliott, "and you just have to have your guard up and always be aware there's always potential that somebody like Freeman's out there trying to take your money."
Freeman was given a 16-year suspended sentence with probation..
He'll get credit for time served, and he's ordered to pay 35-thousand dollars back to his victims..
"The sentence puts the power back in the hands of the victims he stole money from," says Hamilton County Assistant District Attorney Boyd Patterson..
"If he's not paying, he's going to jail."
"I'm just glad that something is being done," says Vivian Putnam, "and Freeman's not out there hurting anybody else still."
Meanwhile, the wheels of justice are turning rather quickly right now..
Freeman is now due in court in Catoosa County, Georgia TOMORROW, to answer to a charge of theft by conversion involving cabinets that were paid for THERE, and never delivered..

Prosecutors say he's much worse than that..
"It's incredible, Calvin," says assistant Hamilton County District Attorney Boyd Patterson, "it's something where there are white collar criminals, but this guy is in a different league."
Our NewsChannel Nine investigation of cabinet maker David Freeman began about three years ago..
Vivian Putnam is one of many homeowners in Hamilton County who paid Freeman thousands of dollars for custom made cabinets that were never made..
"He left us with what we had years ago," says Ms. Putnam, "and that was what I was trying to get away form."
At the same time, prosecutors say Freeman was also busy ripping off people in Rhea and Sequatchie Counties..
"I saw it on your show," says victim Robert Johnson..
These four homeowners ALSO paid for cabinets they didn't get..
Word of mouth about Freeman was spreading fast..
Catoosa County and Walker County ALSO had victims, because Freeman wasn't calling anybody back..
"Actually after seeing your show," says attorney Ronald Roach, "(my victim) Mr. McDonald is pursuing charges."
And in the strangest twist of all, our investigation THEN discovered that Freeman had been previously convicted in Whitfield County, Georgia for writing 20-thousand dollars in bad checks..
"These were felony offenses," said probation officer Cindy McClure two years ago, "he pleaded guilty and was sentenced to three years probation."
All of that was BEFORE he'd met ANY of the Tennessee people who would eventually become his victims..
A Whitfield County judge ordered Freeman to make the bad checks good...
"He paid a little bit of restitution," says Whitfield County District Attorney Kermit McManus, "then he didn't pay any more."
Apparently, Georgia was not aware of Freeman's arrests in Tennessee..
Our tips, led Georgiainvestigators to re-evaluate Freeman's probation status..
"We certainly appreciate your information," said Ms. McClure, "as we do anybody in the public that assists us."
Turns out, it's quite possible that Georgia may not have ever known that Freeman was in trouble in Tennessee.. our continuing investigation has turned up a serious flaw in the legal system..
"There just not a line of communication that established between district attorney offices or even police agencies," says Mr. McManus, "other than just general crime information computers once a person is convicted."
Mr. McManus says when a suspect FIRST encounters the legal system, there needs to be a connection between neighboring prosecutors, "to keep people from slipping through the cracks," he says..
Meanwhile, Freeman has been convicted in Hamilton County, Rhea County, Catoosa County, and Walker County, AND he's been ordered to return more than 76-thousand dollars to his Tennessee and Georgia victims.
"He stole so much money from so many people," says Mr. Patterson, "I'd be blown away if he doesn't have some money socked away somewhere."
Freeman is currently serving time in a state prison near Atlanta on those Whitfield County bad check charges.
Many victims are waiting to see if they'll ever get all of their money back..
"I was really discouraged because I went through so much," says Ms. Putnam, "and I really thank you for what assistance you provided."
So WHERE'S THE MONEY?
Those thousands of dollars Freeman got from people to build cabinets?..
Nobody knows but Freeman, and he ain't talking..
Assistant D-A Boyd Patterson says, if Freeman DOES have a secret stash somewhere, he'd better start dipping into it to pay these people back, otherwise, he'll go to a TENNESSEE prison, once Georgia lets him go..
By the way, Freeman's court date on the North Carolina charges will be September 27th, problem is, he'll still be in the Georgia prison system then..
And right now, we're told there's a pilot program in middle Georgia going on right now to connect the various district attorney offices there, but until the State of Georgia, or Tennessee for that matter, steps up and says, this is what we wanna do, and this is how we'll fund it, prosecutors will just have to hope they get phone calls from each other..

Our NewsChannel Nine investigation of cabinet maker David Freeman began about three years ago..
Vivian Putnam is one of many homeowners in Hamilton County who paid Freeman thousands of dollars for custom made cabinets that were never made..
"He left us with what we had years ago," says Ms. Putnam, "and that was what I was trying to get away form."
At the same time, prosecutors say Freeman was also busy ripping off people in Rhea and Sequatchie Counties..
"I saw it on your show," says victim Robert Johnson..
These four homeowners ALSO paid for cabinets they didn't get..
Word of mouth about Freeman was spreading fast..
Catoosa County and Walker County ALSO had victims, because Freeman wasn't calling anybody back..
"Actually after seeing your show," says attorney Ronald Roach, "(my victim) Mr. McDonald is pursuing charges."
And in the strangest twist of all, our investigation THEN discovered that Freeman had been previously convicted in Whitfield County, Georgia for writing 20-thousand dollars in bad checks..
"These were felony offenses," said probation officer Cindy McClure two years ago, "he pleaded guilty and was sentenced to three years probation."
All of that was BEFORE he'd met ANY of the Tennessee people who would eventually become his victims..
A Whitfield County judge ordered Freeman to make the bad checks good...
"He paid a little bit of restitution," says Whitfield County District Attorney Kermit McManus, "then he didn't pay any more."
Apparently, Georgia was not aware of Freeman's arrests in Tennessee..
Our tips, led Georgiainvestigators to re-evaluate Freeman's probation status..
"We certainly appreciate your information," said Ms. McClure, "as we do anybody in the public that assists us."
Turns out, it's quite possible that Georgia may not have ever known that Freeman was in trouble in Tennessee.. our continuing investigation has turned up a serious flaw in the legal system..
"There just not a line of communication that established between district attorney offices or even police agencies," says Mr. McManus, "other than just general crime information computers once a person is convicted."
Mr. McManus says when a suspect FIRST encounters the legal system, there needs to be a connection between neighboring prosecutors, "to keep people from slipping through the cracks," he says..
Meanwhile, Freeman has been convicted in Hamilton County, Rhea County, Catoosa County, and Walker County, AND he's been ordered to return more than 76-thousand dollars to his Tennessee and Georgia victims.
"He stole so much money from so many people," says Mr. Patterson, "I'd be blown away if he doesn't have some money socked away somewhere."
Freeman is currently serving time in a state prison near Atlanta on those Whitfield County bad check charges.
Many victims are waiting to see if they'll ever get all of their money back..
"I was really discouraged because I went through so much," says Ms. Putnam, "and I really thank you for what assistance you provided."
So WHERE'S THE MONEY?
Those thousands of dollars Freeman got from people to build cabinets?..
Nobody knows but Freeman, and he ain't talking..
Assistant D-A Boyd Patterson says, if Freeman DOES have a secret stash somewhere, he'd better start dipping into it to pay these people back, otherwise, he'll go to a TENNESSEE prison, once Georgia lets him go..
By the way, Freeman's court date on the North Carolina charges will be September 27th, problem is, he'll still be in the Georgia prison system then..
And right now, we're told there's a pilot program in middle Georgia going on right now to connect the various district attorney offices there, but until the State of Georgia, or Tennessee for that matter, steps up and says, this is what we wanna do, and this is how we'll fund it, prosecutors will just have to hope they get phone calls from each other..

| David Earl Freeman Binds Misappropriation Cases Over As Angry Victims Watch People Say They Pay Thousands, Don't Get Cabinets, Countertops posted July 1, 2004 A man who has allegedly bilked dozens of customers out of deposits paid for cabinets and countertops had three cases bound to the Grand Jury on Thursday. A number of those who say they are victims of David Earl Freeman watched in the courtroom of General Sessions Court Judge Ron Durby. Ben Crownover said there were 30 victims in court, and there are numerous others he has located. Freeman, 48, of Belvoir Avenue, is free on three $5,000 bonds. Mr. Crownover said he was referred to Freeman by builder Johnny Johnson. He said he agreed to buy cabinets from Freeman and paid him $5,500 upfront. He said he never got the cabinets. Mr. Crownover said he went to the firm where Freeman was to have gotten the cabinets and was told of other "victims." He said he also went to a countertop company and was given more names. He said Freeman takes orders for cabinets and countertops, gets deposits of 50 percent or more of the price, then doesn't deliver. Mr. Crownover, "There are some people here from Walker County. We hear there are victims in Cumberland County." One angry man at the courthouse called Freeman "a predator." Another said his mother-in-law had given Freeman $4,000 and never got any cabinets.
